Your rights and obligations when using our digital services.
For the purpose of this Terms of Use the word 'Service' means the Member Relationship Management (MRM) platform, applications, website, software, features, updates, integrations and related digital services provided by RCCG RHN. The term 'Provider' means RCCG RHN and 'Users' means RHN Church Members. Our service is a cloud-based digital service designed to help members to access our administrative services and activities seamlessly.
These Terms explain your rights and obligations when using our services, permitted and prohibited uses, account responsibilities, data ownership, privacy obligations, intellectual property rights, security responsibilities, limitations of liability and termination rights.
A legally binding agreement is formed when you create an account, you accept these Terms electronically and you access or use our services.
We may update these Terms from time to time. Changes may be made to reflect legal requirements, regulatory changes, security improvements, new features and changes to non-profit operations. Where changes materially affect member rights a reasonable notice will be provided. Continued use of the service after changes become effective constitutes acceptance of the updated Terms.
To use the service, you must be legally capable of entering into a binding agreement, provide accurate registration information, comply with these Terms and comply with applicable laws.
To access certain service functionality, you must create an account. You may be required to provide name, email address, contact information and authentication details. You must ensure that all information provided is accurate, complete and current. You must promptly update information that changes.
The Member may use the service to relate with services provided by RCCG RHN such as managing member communications, joining departments and volunteering. RCCG RHN may approve or reject account requests, verify identity, request additional information and restrict access where necessary.
You are responsible for maintaining the confidentiality of usernames, passwords, authentication credentials and security tokens. You must not share account credentials, allow unauthorised persons to access your account or transfer your account without permission. Each user should have an individual account where technically possible. You must notify the Provider immediately if you suspect unauthorised access, credential compromise, security vulnerabilities or misuse of your account.
The Member must not use the service for activities that breach applicable laws, infringe third-party rights, facilitate fraud, facilitate cybercrime, violate privacy rights or distribute unlawful content.
The Provider and its licensors own all rights, title and interest in and to the Service. These rights are protected under applicable intellectual property laws, including copyright legislation, database rights, trade mark laws, trade secret protections and applicable software protection laws. Nothing in these Terms transfers ownership of the Service to the Users.
If the User provides suggestions, comments, ideas or recommendations regarding the Service, the Provider may use such feedback to improve its services. The User grants the Provider a non-exclusive, worldwide, royalty-free right to use such feedback without obligation to compensate the User.
Availability Commitment: The Provider will use reasonable efforts to maintain availability of the Service. However, the Provider does not guarantee uninterrupted operation, continuous availability, absence of errors or compatibility with every device or system.
Service Interruption: The Service may temporarily become unavailable due to scheduled maintenance, emergency repairs, cybersecurity incidents, infrastructure failures, telecommunications problems, third-party service interruptions and events outside reasonable control.
Planned Maintenance: Where reasonably possible, the Provider will provide advance notice of planned maintenance that may materially affect access.
The Provider maintains appropriate resilience measures designed to support service continuity. These may include backups, recovery procedures, monitoring, redundancy and incident response processes. The Provider will take reasonable steps to restore services following significant disruption.
Right to Suspend: The Provider may suspend or restrict access to the Service where reasonably necessary to protect the security of the Platform, Members Data, the Provider's systems and compliance with legal obligations.
Reasons for Suspension: Access may be suspended where the User breaches these Terms, suspicious or fraudulent activity is detected, unauthorised access is suspected, the User violates applicable laws, continued use creates a security risk or where required by a regulator or competent authority.
Notice of Suspension: Where reasonably possible, the Provider will provide notice explaining the reason for suspension, the expected duration and steps required to restore access. However, immediate suspension may occur where necessary to prevent harm.
Restoration of Access: Access may be restored once the issue has been resolved, security concerns have been addressed and compliance requirements have been satisfied.
Except where prohibited by law, the Service is provided on an "as available" basis. The Provider does not guarantee that the Service will be uninterrupted, that all errors will be corrected, that the Service will meet every User's requirement or that third-party integrations will operate without interruption.
Cross-Border Processing: Where Users' Data is transferred internationally, the Provider will implement appropriate safeguards. These may include UK International Data Transfer Agreement (IDTA), UK Addendum to EU Standard Contractual Clauses, EU Standard Contractual Clauses, adequacy decisions and other lawful mechanisms.
Sub-processors: The Provider may use approved sub-processors to deliver Services. The Provider remains responsible for ensuring appropriate contractual safeguards are implemented.
Unless mandatory law requires otherwise, these Terms shall be governed by the laws of England and Wales.
The parties will attempt to resolve disputes through good-faith discussions. Where resolution cannot be achieved, disputes shall be submitted to the courts having appropriate jurisdiction under applicable law.
The Provider may update these Terms periodically. Changes may occur because of legal developments, regulatory requirements, security improvements and changes to Service functionality.
Formal notices must be provided between parties electronically through approved communication channels.
Entire Agreement: These Terms and incorporated documents represent the entire agreement between the parties regarding Service use.
Severability: If any provision becomes invalid, the remaining provisions continue in effect.
Assignment: The User may not transfer rights under these Terms without consent. The Provider may transfer rights as part of a merger, acquisition, restructuring or charitable transfer.
Waiver: Failure by the Provider to enforce any provision of these Terms does not constitute a waiver of the right to enforce that provision in future.
